As you know AOL is one of the premier global online companies and the owner of exclusive registered rights to the famous AOL trademark including registrations in the United States China and numerous other countries. AOL uses its name and trademark to provide a wide range of online and other services at www.aol.com and numerous other sites. Over the years consumers have come to associate the AOL brand exclusively with AOL and its high-quality services.
It has come to our attention that you have registered and are making commercial use of the infringing domain name “AOL.site”. See screen shot below.
Your actions demonstrate a knowing and willful attempt to profit off the goodwill AOL has created in its famous trademark. Trademark and false advertising laws expressly prohibit this type of misleading and infringing activity and allow trademark owners to seek significant penalties against those who misuse trademarks in this manner including permanent injunctions and awards of attorneys fees.
Our preliminary investigation shows that you have provided false contact information in the Whois records associated with the “AOL.site” domain name. We plan to file a complaint with your registrar and ICANN regarding your intentional use of false contact information.
AOL is taking this matter very seriously and is prepared to take whatever legal action is necessary to ensure you do not mislead consumers or infringe AOL’s intellectual property. If possible AOL would prefer an amicable resolution. To that end I must insist that you immediately stop all uses of AOL’s names and trademarks including but not limited to those identified in this letter. AOL also must insist that you transfer “AOL.site” and any similar domain name to our client.
If you fail to cooperate immediately I will have no choice but to advise AOL of its available legal remedies against you. I hope that is not necessary and you will respond and cooperate immediately.
AOL reserves all its rights against you.
